Tonis
These Terms govern your use of the Tonis mobile app and related services, provided by Digital Therapeutics Solutions LLC (“we,” “us”). By downloading or using Tonis, you agree to these Terms. If you do not agree, do not use the app.
Tonis is a wellness and fitness product, not a medical device. Its measurements, scores and exercises are for general fitness and informational purposes only. They are not a diagnosis, and they are not a substitute for professional medical, dental, orthodontic or psychological advice. Consult a qualified professional before starting any new exercise routine, and stop immediately if you experience pain — particularly jaw pain, which can indicate a temporomandibular disorder.
You must be able to form a binding contract where you live. You are responsible for the accuracy of your account information, for keeping your credentials secure, and for activity under your account. Tonis is not intended for children under 13.
Tonis offers an optional auto-renewing subscription (“Tonis Pro”) that unlocks the full exercise library, unlimited scans, complete metric detail and full history.

You keep ownership of everything you create in Tonis — your scans, photographs and workout history. You grant us only the limited licence needed to store, process and display that content back to you so the app can function. We do not use your facial data for any purpose beyond providing the service to you. See our Privacy Policy for details.
The app, its exercise library, instructional videos, artwork, scoring methodology and trademarks are owned by Digital Therapeutics Solutions LLC and protected by intellectual property law. We grant you a personal, non-transferable, revocable licence to use Tonis for your own non-commercial use.
Facial measurements are estimates derived from depth-camera data. Their accuracy depends on lighting, distance, angle, device hardware and how consistently you scan. Scores are intended to track your own change over time, not to rank you against other people or to represent any clinical or objective standard of appearance. We make no guarantee of any particular result from using the exercises.
You may stop using Tonis and delete your account at any time from Profile → Account → Delete Account. We may suspend or terminate access if you breach these Terms or use the service in a way that harms other users or us.
The service is provided “as is” and “as available,” without warranties of any kind to the fullest extent permitted by law, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted or error-free.
To the maximum extent permitted by law, Digital Therapeutics Solutions LLC will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of data, profits or goodwill. Our total liability for any claim relating to the service is limited to the greater of the amount you paid us in the 12 months before the claim, or $50. Some jurisdictions do not allow these limitations, in which case they apply to the fullest extent permitted.
We may update these Terms. If changes are material, we will notify you in the app or by email. Continuing to use Tonis after changes take effect means you accept the updated Terms.
These Terms are governed by the laws of the United States and the State of Delaware, without regard to conflict-of-law principles. Nothing here removes consumer protections you have under the mandatory laws of your country of residence.
Apple is not a party to these Terms and has no responsibility for Tonis. Apple is a third-party beneficiary of these Terms and may enforce them against you. Any claim relating to your possession or use of Tonis is between you and us, not Apple.
